Hirschler litigation partner Mihir Elchuri authored an article for Law360 as part of their Law School’s Missed Lessons series providing insight on how to survive a long trial.

Elchuri emphasizes how trying cases with a long timeline is an exercise in physical, mental and strategic durability. While there will be ups and downs, lawyers cannot afford to allow their emotions to fluctuate by the roller coaster of events during a trial. It is important to take one step at a time and be sure to pick your battles well. He also discusses the strategic importance of having someone serve as the field general to direct the efforts of the team throughout the process.

Some key steps Elchuri identifies for long term success during a lengthy trial are: 1) be organized from the start; 2) manage your client instead of the case; 3) protect your own capacity; and, 4)  take a long term view of the situation.

“The lawyers who handle lengthy trials most effectively understand that they are won as much through composure, organization and credibility with the jury as they are through a cross-examination or closing argument,” said Elchuri.
