In an article published by Virginia Business on Dec. 22, 2016, Andy Sherrod and co-author discuss why companies could still have unfinished business despite the uncertainty surrounding the DOL’s proposed overtime rules. The article details the Texas federal judge who issued a nationwide preliminary injunction against the implementation and enforcement of regulations proposed by the DOL to update exemptions from the overtime requirements for executive, administrative and professional (EAP) employees. While this injunction has provided additional time for employers to prepare, Sherrod and his co-author emphasize that, “Given the potential for salary requirements to change quickly based on future decisions in the pending case, employers should be prepared to re-classify such employees or to adjust their compensation to comply with any changes to the EAP exemptions.” To access the article, click here.
