In an article published in Law360 on Aug. 12, 2015, Jeff Newhouse and Jaime Wisegarver discuss the impact of a recent ruling in a New Jersey class action suit, in which Hirschler Fleischer obtained a favorable result for the defendants. U.S. District Judge Stanley Chesler’s ruling in Alegre v. Atlantic Central Logistic, et al. provides clarity to the application of the Class Action Fairness Act (CAFA) in New Jersey. The ruling lessened the evidentiary standard used to establish the “amount in controversy,” a key factor in determining whether a case is heard by state or federal court under CAFA.
