In the article titled Workplace Harassment: ‘Disinfecting The Workplace With Sunlight’, Andy Sherrod and Matt Sarfan discuss how recent legislation, such as the Speak Out Act, addresses the use of "blanket NDAs" related to sexual harassment and assault, and how state laws may further restrict the use of non-disclosure provisions in both employment and settlement contexts.  Employers need to carefully reexamine their agreement forms to ensure compliance with changing laws and enforceability of confidentiality and non-disparagement clauses.
